2023 NEW YORK STATE LEGISLATIVE AGENDA

CCE works to advance legislation that will protect our natural environment and public health, while working to oppose legislation that will have an adverse impact on our shared environment. Below is a list of proposed legislative and budget items that CCE will be working to advance or oppose in the 2023 New York State legislative session. 

Legislative Agenda:

Birds and Bees Protection Act (S.1856A – Hoylman-Sigal / A.7640 - Glick) 
Bans the use of neonic pesticides for treated seeds and ornamental/turf applications

Requires Manufacturers to fund recycling and reduce waste for product packaging

Ban on PFAS in Everyday Products (S.5648 – Hoylman-Sigal / A.3556 - Zebrowski) 
Bans the sale of PFAS in textile articles, rugs, fabric treatments, cookware, ski waxes, architectural paints, and cleaning products, beginning in 2025

Enhanced Public Participation Act (S.2510A – Ramos/A.6584A - Gallagher) 
Requires applicants for major projects located near a disadvantaged community to submit an enhanced public participation plan

Safe Personal Care and Cosmetics Act (S.4265 – Webb/A.6969 – Glick) 
Bans certain chemicals in personal care products and cosmetics that harm human health and the environment

Ban on PFAS in Antifogging Sprays and Wipes (A.5363 – Gallagher/S.992 Hoylman-Sigal) 
Bans PFAS in antifogging sprays and wipes beginning in 2024

Safe Menstrual Products (S.3529 – Fernandez/A.5990 – Rosenthal) 
Bans PFAS, formaldehyde, and other toxic chemicals in menstrual care products

Planned Offshore Wind Transmission Act (S.6218A – Parker /A.7764 – Mitaynes)
Requires NYSERDA to lead a transmission planning process for offshore wind and authorizes temporary parkland alienation in City of Long Beach for an offshore wind cable construction and operation

Local Prohibition of Pesticides on Wetlands (S.5957 – Harckham /A.5949 – Burdick
Allows local governments that have adopted a local freshwater wetlands protection local law to restrict pesticide use on wetlands they regulate

Expanded Recycling of Rechargeable Batteries (S.643D – Kavanagh /A.7339B – Glick)
Requires battery producers to fund and recycle rechargeable batteries for certain products, including electric bikes and scooters.

Expanded Stream Protections (A.4601A – Glick / S.1725A – Harckham)
Expands New York State DEC’s stream protection provisions of the Protection of Waters regulations to include Class C Streams

Maximum Contaminant Level Goals (S.2927 – Cleare / A.2996 – Thiele) 
Requires the Department of Health to establish a Maximum Contaminant Level Goal (MCLG) for every emerging contaminant for which it establishes a Maximum Contaminant Level (MCL)

Lead Pipe Right to Know Act (S.5512 – Rivera / A.6115 – Paulin)        
Requires each water utility to inventory its service lines and make information accessible to the public

State Open Space Conservation Efficiency (S.6606 – May / A.7372 – Thiele)
Allows the Attorney General to approve title transfers using title insurance for land acquisition for the purpose of land conservation

Enacts an indefinite ban on renewable wind power in the Great Lakes
